1. Description of Service

Bloom is a SaaS platform that allows business owners to deploy AI sales agents on their websites and third-party messaging channels without technical skills. Utilizing locally hosted AI models, the Service enables these AI agents to handle customer conversations, answer product questions, take orders, and collect payments on your behalf.

2. Eligibility & Accounts

• Age Requirement: You must be at least 18 years old to use Bloom. By creating an account, you represent and warrant that you meet this requirement.
• Account Creation: You may register using an email and password or via third-party OAuth providers (Google, Facebook). You must provide accurate, complete, and updated information.
• Security: You are responsible for maintaining the confidentiality of your login credentials. We strongly encourage utilizing the Multi-Factor Authentication (MFA) features provided in your account settings. Bloom is not liable for any loss or damage arising from your failure to protect your account.

3. Subscriptions and Payments

• Billing: Access to certain features of Bloom requires a paid subscription. Payments are securely processed via our third-party payment processors, Dodo Payments and Paystack.
• No Refunds: All sales are final. We do not offer refunds, prorated or otherwise, for canceled subscriptions or unused time on your billing cycle. You may cancel your subscription at any time in your account settings, and you will retain access to the Service until the end of your current paid billing period.

4. User Responsibilities & Third-Party Channels

• Messaging Channels: Bloom allows you to connect AI agents to third-party messaging channels (e.g., WhatsApp, Instagram, Facebook Messenger, etc.). You are solely responsible for complying with the Terms of Service and privacy policies of those third-party platforms. Bloom is not responsible if a third-party channel restricts or bans your account.
• Your Customers' Data:You acknowledge that your AI agents will interact with your end-customers. You act as the "Data Controller" for your customers' data, and Bloom acts merely as the "Data Processor." It is your responsibility to ensure you have the legal right, privacy policy, and necessary consent to collect your customers' data and process it through Bloom.
• AI Limitations: While our AI agents are designed to be highly capable, artificial intelligence can occasionally generate inaccurate or unintended responses. Bloom is not liable for any lost sales, customer disputes, or damages resulting from conversations between the AI agent and your customers.

5. Intellectual Property

We own all rights, title, and interest in the Bloom platform, including the software, our locally hosted AI models, interface design, and branding. You retain all rights to your specific business data, descriptions, tags, and the user-generated content you upload to the platform.

6. Disclaimer of Warranties & Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Bloom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Service.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any legal actions or disputes shall be resolved in the courts located in Lagos, Nigeria.
